Silicon Knights' Too Human has been pulled from Xbox Live Marketplace. The game remains listed on the Xbox LIVE Marketplace website with a trailer, screens and a description, but all options to purchase the game have been removed. Microsoft earlier confirmed that Too Human had been pulled from Xbox Marketplace due to a recall notice from Silicon Knights:
“Microsoft received a Recall Notice from Silicon Knights for Too Human, and we have removed the game from Xbox LIVE Marketplace accordingly. We have no comment regarding, nor involvement with the case between Silicon Knights and Epic.”
This comes after Silicon Knights defeat in a lengthy legal battle with Epic Games over Unreal Engine 3 - the tech used to power Too Human and several other Silicon Knights titles. The problems started in 2007 when Silicon Knights served Epic with a lawsuit claiming it was "mislead" about how complete Unreal Engine 3 code actually was. Epic was basically accused of "sabotaging" Unreal Engine 3 licensees by withholding an improved version of the engine and investing licensing fees in Gears of War development rather than the game making tool.
A 2012 court ruling ordered Silicon Knights to cease producing or distributing all its games using Epic Games' Unreal Engine, which includes Too Human. It is not clear if the game's disappearance from Xbox Live is in any way connected to this. When we find out more, we will let you know.
